SMS and data privacy When you provide your mobile number through a Sound Merge Pro-managed form or via a customer system integrated with our platform, we process your information as a service provider to that customer. • We use mobile numbers and associated metadata solely to deliver and manage SMS programs as instructed by our customers. • We do not sell mobile numbers or use them to market services unrelated to the originating program without appropriate consent. • We retain consent and messaging history for as long as necessary to support the program, comply with legal obligations, and maintain audit trails, after which data is deleted or de-identified where feasible.

How we use information We use information to: • Operate, monitor, and improve our messaging and compliance services; • Register and maintain A2P 10DLC and toll-free SMS campaigns; • Provide reporting, support, and security monitoring; • Satisfy legal and regulatory obligations, including responding to lawful requests from authorities.

3. SMS terms and acceptable use If you use Sound Merge Pro in connection with SMS programs: • You are solely responsible for the content of your messages, the timing of sends, and the targeting of recipients. • You must obtain and maintain valid consent from subscribers, provide clear disclosures, and honor opt-out requests without undue delay. • You must adhere to carrier codes of conduct, CTIA guidelines, and applicable telemarketing and privacy laws. • You may not use the services for unlawful, fraudulent, or abusive purposes, including but not limited to unsolicited marketing, harassment, or prohibited content categories.

4. Subscriber-facing disclosures You agree to provide subscribers with accurate program descriptions, frequency expectations, and instructions for obtaining help and opting out. 5. No carrier or partner liability Carriers and downstream messaging providers are not liable for delayed or undelivered messages. While Sound Merge Pro implements technical and operational safeguards, message delivery is not guaranteed.

6. Service changes and termination We may modify or discontinue features from time to time. We may suspend or terminate access if you materially breach these terms, including misuse of SMS capabilities or failure to honor subscriber rights.

7. Disclaimers and limitation of liability To the maximum extent permitted by law, the services are provided “as is” and “as available.” Sound Merge Pro does not warrant uninterrupted or error-free operation. Our aggregate liability arising from or related to the services is limited to the amounts paid for the services during the twelve months preceding the event giving rise to the claim.
